Terms of use for online shop

These terms of use (hereinafter referred to as "these terms") stipulate the terms and conditions for the use of the online shop (hereinafter referred to as "the Service") provided by B.U.M. Logistics Co., Ltd. (hereinafter referred to as "the Company") on this website. Users (hereinafter referred to as "Users") are requested to use the Service in accordance with these terms.

Article 1 (Application)

These terms shall apply to all relationships related to the use of the Service between the User and the Company.
In addition to these terms, the Company may establish various provisions (hereinafter referred to as "Individual Provisions") such as rules for use when using the Service. Regardless of their names, these Individual Provisions constitute part of these terms.
In the event of any inconsistency between the provisions of these terms and the provisions of the Individual Provisions under the preceding paragraph, the provisions of the Individual Provisions shall take precedence, unless otherwise specified in the Individual Provisions.

Article 2 (User Registration)

In the Service, a person who wishes to register will apply for user registration by agreeing to these terms and following the method specified by the Company. User registration is completed when the Company notifies the applicant of approval for the registration.
If the Company determines that the applicant for user registration has any of the following reasons, the Company may not approve the application for user registration, and shall not be obligated to disclose the reasons:
- If false information is provided during the application for user registration.
- If the applicant has violated these terms.
- If the Company deems the application for user registration to be inappropriate for any other reason.

Article 3 (Management of User ID and Password)

Users are responsible for managing their user ID and password for the Service at their own risk.
Under no circumstances should users transfer, lend, or share their user ID and password with third parties. If the combination of a user ID and password matches the registration information and is logged in, the Company will consider it as use by the user who registered that user ID.
Except in cases where the Company is intentionally or grossly negligent, the Company shall not be liable for any damages caused by the use of the user ID and password by a third party.

Article 4 (Purchase Agreement)

In the Service, a sales contract is concluded when the User applies for a purchase to the Company, and the Company notifies the User of the acceptance of the application. The ownership of the product shall be transferred to the User when the Company delivers the product to the delivery carrier.
The Company may cancel the aforementioned sales contract without prior notice to the User if the User falls under any of the following reasons:
- Violation of these terms by the User.
- Non-completion of product delivery due to unclear delivery destination or prolonged absence.
- Any other situation where the trust relationship between the Company and the User is deemed to be impaired.
Methods of payment, delivery, cancellation of purchase applications, or return methods related to the Service shall be determined separately by the Company.

Article 5 (Intellectual Property Rights)

The copyright and other intellectual property rights of the content, including product photos, provided by the Service (hereinafter referred to as "Content") belong to the Company, content providers, and other legitimate right holders. Users are not allowed to replicate, reprint, modify, or otherwise use the Content without permission.

Article 6 (Prohibited Activities)

Users must not engage in the following activities when using the Service:
- Acts that violate laws or public order and morals.
- Acts related to criminal activities.
- Acts that infringe on copyrights, trademark rights, or other intellectual property rights included in the Service.
- Acts that disrupt or interfere with the functions of the Company's servers or networks.
- Commercial use of information obtained through the Service.
- Acts that may interfere with the operation of the Company's services.
- Unauthorized access or attempted unauthorized access.
- Collection or accumulation of personal information about other users.
- Impersonation of other users.
- Acts directly or indirectly providing benefits to antisocial forces related to the Company's services.
- Any other acts deemed inappropriate by the Company.

Article 7 (Suspension of Service Provision, etc.)

If the Company determines that any of the following reasons exist, the Company may suspend or interrupt the provision of all or part of the Service without prior notice to the User:
- Maintenance, inspection, or update of the computer system for the Service.
- Natural disasters, such as earthquakes, lightning, fires, power outages, or other force majeure events that make it difficult to provide the Service.
- Suspension of the computer or communication lines due to accidents.
- Other situations where the Company deems it difficult to provide the Service.
The Company shall not be liable for any disadvantages or damages suffered by the User or a third party due to the suspension or interruption of the provision of the Service.

Article 8 (Usage Restriction and Registration Deletion)

If any of the following circumstances applies, the Company may, without prior notice, restrict the use of all or part of the Service or delete the registration as a User:
- Violation of any provision of these terms.
- Discovery of false information in the registered details.
- The credit card reported by the User as a payment method has been suspended.
- Non-performance of payment obligations, such as fees.
- No response to contact from the Company for a certain period.
- No use of the Service for a certain period from the last use.
The Company shall not be liable for any damages caused to the User by the actions taken by the Company based on this article.

Article 9 (Withdrawal)

Users can withdraw from the Service through the prescribed withdrawal procedures.

Article 10 (Disclaimer and Disclaimer)

The Company does not guarantee that the Service is free from defects (including defects in safety, reliability, accuracy, completeness, effectiveness, suitability for a specific purpose, security, etc.) in fact or law.
The Company shall not be liable for any damages incurred by the User through the use of the Service. However, if the contract between the Company and the User regarding the Service (including these terms) is a consumer contract under the Consumer Contract Act, this disclaimer provision shall not apply. Even in such a case, the Company shall not be liable for damages caused to the User by the Company's negligence (excluding gross negligence) or unlawful act, except for damages arising from special circumstances (including those that the Company or the User could foresee regarding the occurrence of damages).
The Company shall not be responsible for any transactions, contacts, or disputes between the User and other users or third parties in connection with the Service.

Article 11 (Changes to Service Content, etc.)

The Company may change the content of the Service or suspend the provision of the Service without notifying the User. The Company shall not be liable for any damages caused to the User as a result of such changes.

Article 12 (Changes to Terms of Use)

The Company may change these terms at any time without prior notice to the User if deemed necessary. However, if the User starts using the Service after the change of these terms, the User will be deemed to have agreed to the amended terms.

Article 13 (Handling of Personal Information)

The Company will handle personal information obtained through the use of the Service appropriately in accordance with the Company's "Privacy Policy."

Article 14 (Notification or Contact)

Notifications or contacts between the User and the Company shall be made in the manner specified by the Company. The Company will notify or

 contact the User at the contact information currently registered as valid unless the User notifies the Company of any changes according to the Company's designated method. Notifications or contacts shall be deemed to have reached the User at the time of transmission.

Article 15 (Prohibition of Assignment of Rights and Obligations)

Without the prior written consent of the Company, the User shall not transfer or pledge its position under the usage contract or rights or obligations based on these terms to a third party.

Article 16 (Governing Law and Jurisdiction)

The interpretation of these terms shall be governed by Japanese law. However, regarding the Service, the application of the United Nations Convention on Contracts for the International Sale of Goods shall be excluded.
In the event of a dispute arising from the Service, the exclusive jurisdictional court shall be the court having jurisdiction over the location of the Company's principal office.
